No, favors the driver's side moreso but doesn't make contact at all. Regarding the chassis plate, some have been able to reinstall it, some leave it off depending on how the exhaust is clocked. Can always use spacers there though if necessary.See Picture,looks close here where it turns,rubbing under expanding?also are you able to put back the chassis plate without rubbing?

I'm going to have to go with BMW did not put it there because it was unneeded. The VRSF 3.5'' comes with spacers for the brace so you can use it IIRC. I would want to retain the brace. It also would stop your driveshaft from turning you car into a pogo stick on the strip like a drive shaft loop, to a degree.
I have a different 3.5" exhaust but this brace cleared the exhaust on my E90. Barely but it did.

Just to be clear, for liability reasons we definitely wouldn't recommend eliminating the brace although a lot of guys do. We would suggest spending more time adjusting the exhaust to clear (lots of adjustment on our setup) or spacing it.
